Fences: Who Owns It, Who Maintains It?

The first rule of fence ownership is simple: do not assume. A fence near a property line may belong to you, your neighbor, both parties under local rules, or may even sit slightly inside one property. Before repairing, replacing or removing it, check your survey, deed information and local requirements.

Who maintains the fence?

Responsibility depends on where the fence sits, who installed it, any written agreement and local law. If the fence is clearly on your property, maintenance is generally your responsibility. Shared boundary fences can be more complicated, which is why a short conversation before spending money is usually better than a long argument afterward.

How to work with the neighbor

If one neighbor wants a premium upgrade and the other only wants a functional fence, agree in advance on who pays the difference.

Good-neighbor rule: The property line matters, but so does the relationship. A calm conversation over the fence is generally cheaper than a dispute about the fence.
